Adams v. Federal Trade Commission
United States Court of Appeals for the Eighth Circuit
296 F.2d 861 (1961)
- Written by Susie Cowen, JD
Facts
The Federal Trade Commission (FTC) (plaintiff) issued a complaint alleging that the Adams Dairy Company and its officers (defendants) had engaged in a conspiracy to set prices in violation of the Federal Trade Commission Act. The hearing examiner issued six subpoenas for various documents from the defendants. Adams refused to comply on the ground that the subpoenas called for irrelevant material and that their scope was unduly broad and burdensome. The FTC sought judicial enforcement of the subpoena. The district court denied enforcement of part or all of a number of specifications in the subpoena. The FTC appealed the decision.
