Facts
Justin Adkins (plaintiff) was arrested during an Occupy Wall Street protest in 2011. Police held Adkins, who was a transgender man, in a general cell with other male detainees. Then, the police removed Adkins to an isolated cell, where he was handcuffed to a wall and denied food. Adkins sued the state of New York (defendant), alleging disparate treatment and discriminatory intent in violation of the Fourteenth Amendment to the United States Constitution. New York filed a motion to dismiss for failure to state a claim.
