Facts
Advanced Manufacturing Technologies, Inc. (ATM) (plaintiff) sued Motorola, Inc. (defendant). Douglas Irish and his law firm represented Motorola in the litigation, which had been going on for three years. Merlin Dean Corley was a former Motorola employee and a material witness in the case. In preparing for his deposition, Corley communicated regularly with Irish. Irish also appeared at the deposition, where Corley testified that he was represented by Irish. Irish did not say anything in response to this testimony. Ultimately, it became clear that Corley’s interests were averse to Motorola in the matter. At that point, Corley filed a motion to disqualify Irish and his law firm from representing Motorola due to their prior communications.
