Facts
At the trial of Miguel Angel Aguilera (defendant), the prosecution (plaintiff) called S.G. as a witness. S.G. was seven years old at the time, had repeated first grade, and had a learning disability. The trial court permitted the prosecution to ask S.G. leading questions on direct examination. Aguilera was convicted and appealed on the ground that the leading questions posed to S.G. were improper.
