Facts
Eden Ahbez (plaintiff) owned the copyright for the song “Nature Boy,” which Ahbez had written and composed. Edwin H. Morris Company (EHM) (defendant), without Ahbez’s permission, published, licensed, recorded, and otherwise commercially exploited “Nature Boy” across Europe starting in 1948. Ahbez filed a copyright-infringement action against EHM in the United States seeking monetary damages and a permanent injunction against future infringements. EHM moved to dismiss, arguing that the court lacked subject-matter jurisdiction over Ahbez’s action because Ahbez’s complaint exclusively involved infringing acts undertaken in Europe.
