Facts
Twenty-nine people (plaintiffs), part of a group of people who lived illegally in huts constructed on the pavement next to Rakhial Road in Ahmedabad, filed a writ petition in Gujarat High Court. The Ahmedabad Municipal Corporation (corporation) (defendant) sought to remove the huts through an action filed in the high court under Article 226 of the Constitution of India. The high court ordered the corporation not to remove the huts until suitable accommodation was provided for the hut-dwellers. The corporation appealed to the India Supreme Court, which ordered the corporation to provide a scheme to allow the affected individuals to shift their accommodations within two months. The corporation offered housing to the hut-dwellers, but the hut-dwellers complained that the housing was far away from the pavement, which hosted the hut-dwellers’ businesses.
