Facts
ECS made a complaint regarding Akzo Chemie BV and Akzo Chemie UK Ltd. (collectively, Akzo) (plaintiffs) to the Commission of the European Communities (the commission) (defendant). During the resulting investigation, the commission obtained several documents belonging to Akzo from Akzo’s offices. Akzo identified to the commission which of these documents were confidential. The commission provided ECS with some of the documents that Akzo had identified as confidential. Four days later, the commission notified Akzo that it had sent these documents to ECS, including an explanation for the decision, and emphasized that the commission was entitled to decide whether a document was confidential. Subsequently, Akzo brought an action requesting the European Union Court of Justice to declare void the commission’s decision to transmit confidential documents to ECS.
