Facts
Anwar Al-Aulaqi’s father (plaintiff) sued the president, the Secretary of Defense, and the director of the CIA to prevent the targeted killing of Al-Aulaqi. Al-Aulaqi was a dual United States-Yemeni citizen living in Yemen who was placed on a kill list by the United States government because he was an Al Qaeda leader plotting terrorist attacks against the United States. Al-Aulaqi’s father argued that lethal force against a United States citizen was unconstitutional without evidence that lethal force was the only means sufficient to prevent an imminent threat to life.
