Alabama-Tombigbee Rivers Coalition v. Kempthorne
United States Court of Appeals for the Eleventh Circuit
477 F.3d 1250 (2007)
- Written by Elliot Stern, JD
Facts
The Fish and Wildlife Service issued a rule listing the Alabama sturgeon as an endangered species under the Endangered Species Act. The Alabama-Tombigbee Rivers Coalition, along with other business interests (plaintiffs), brought a lawsuit challenging the rule. They argued that since the Alabama sturgeon was located solely in the state of Alabama and was not a commercial species, the listing of the species in order to protect it exceeded the limits of the constitutional power granted to the federal government to regulate interstate commerce under the Commerce Clause.
