Facts
Alaska Pacific Trading Company (ALPAC) (plaintiff) contracted with Eagon Forest Products, Inc. (Eagon) (defendant). Under the contract, ALPAC agreed to ship logs from Argentina to Korea between July and August 1993 and Eagon agreed to buy the logs. Subsequent market changes made Eagon’s deal under the contract less appealing, and ALPAC feared Eagon would cancel. ALPAC did not ship the logs by the end of August, and Eagon cancelled the agreement. ALPAC sued for breach, and the trial court granted Eagon’s motion for summary judgment. ALPAC appealed the ruling to the Court of Appeals of Washington.
