Puerto Rico Supreme Court
151 D.P.R. 711 (2000)
- Written by Whitney Waldenberg, JD
Facts
As part of his job, Enrique Castillo de Jesús (plaintiff) went to pick items from Warehouse Ramón Rosa Delgado, Inc. (defendant), including two cases of bottled water. When Castillo de Jesús lifted the first case to place it in the back of his van, one of the bottles exploded and struck his eye. Without receiving evidence as to causation, the trial court determined that Warehouse Ramón Rosa Delgado was liable based on the doctrine of res ipsa loquitor, and the court of appeals affirmed. Warehouse Ramón Rosa Delgado appealed to the Puerto Rico Supreme Court.
