Facts
Walton County (defendant) enacted a new ordinance recognizing the public’s customary right to use all dry-sand beaches in the county for recreation. Alford (plaintiff), a private owner of beachfront property, sued. Alford argued that the county exceeded its authority and that the customary use of dry-sand beaches had to be determined by the courts on a case-by-case basis. The county moved for summary judgment.
