Facts
The Pennsylvania legislature enacted a statute that prohibited spending state funds on an abortion unless the pregnancy was caused by rape or incest or the abortion was necessary to avoid the mother’s death. The Allegheny Reproductive Health Center and other abortion providers (the providers) (plaintiffs) filed a petition in the Commonwealth Court to enjoin the Pennsylvania Department of Human Services (defendant) from enforcing the statute, arguing the statute violated the Pennsylvania Constitution. The Commonwealth Court dismissed the petition. The providers appealed to the Pennsylvania Supreme Court.
