Facts
Alfred Allen (plaintiff) was a veteran who had a 20 percent disability rating for traumatic arthritis of his right knee, which was caused by an injury during service. Allen filed a claim with the Department of Veterans Affairs (VA) (defendant) for a secondary service connection for arthritis of his hips and left knee, which he claimed was aggravated by his right-knee service-connected disability. The VA denied his claim, and Allen appealed to the Board of Veterans’ Appeals (the board). The board upheld the VA’s denial, holding that Allen was not entitled to a secondary service connection because there was no evidence that the arthritis in his hips and left knee had been proximately caused by his right-knee disability. Allen appealed to the United States Court of Appeals for Veterans Claims (the veterans court).
