Facts
More than 1,000 claimants from Utah, Arizona, and Nevada (plaintiffs) alleged that fallout from a nuclear testing site in Nevada caused them to develop cancer. The claims were consolidated into a single negligence action against the United States (defendant) under the Federal Tort Claims Act. A bellwether trial included 24 of the claims in their entirety.
