Almeida v. Correa
Hawaii Supreme Court
465 P.2d 564 (1970)

- Written by Sean Carroll, JD
Facts
Doris Almeida (plaintiff) sued Frank Correa (defendant) seeking a judicial determination of paternity and child support. Over Correa’s objection, the trial court permitted Almeida to carry the nine-month-old baby into the courtroom and present the baby to the jury for approximately 30 seconds. The stated purpose of this presentation was to permit the jurors to observe the baby’s resemblance to Correa as part of their determination of paternity. The jury ruled in Almeida’s favor. Correa appealed.
