Facts
Alpine Investments BV (Alpine) (plaintiff) was a Dutch company that offered financial services, including cold-calling (i.e., calling individuals who had not previously agreed to be contacted to try to gain them as customers). Alpine had customers in the Netherlands and other European Union (EU) member states. Under Dutch law, for companies offering financial services such as those provided by Alpine to engage in cold-calling was illegal. The law did not distinguish between cold-calling potential customers in the Netherlands and those in other EU member states. Alpine brought a lawsuit against the law, arguing that the law violated the freedom to provide services guaranteed under the Treaty on the Functioning of the European Union (TFEU).
