Facts
The state (plaintiff) filed a petition to terminate the Alsagers’ (defendants) parental rights. The Alsagers were served with a copy of the complaint, which alleged merely that the Alsagers had refused to give their children proper care and protection and that the Alsagers were unfit parents. The complaint did not contain specific allegations or the applicable legal standard. The Alsagers filed a complaint in federal court, arguing that the state violated their right to due process by failing to provide notice of the factual allegations that formed the basis of the petition and the legal standard to be applied.
