Facts
Guy Altobello (plaintiff) sued Borden Confectionary Products, Inc. (defendant), alleging Borden fired him because of his age in violation of a federal statute against age discrimination. At trial, Borden impeached Altobello's credibility by introducing evidence that Altobello was previously convicted of misdemeanor theft for tampering with an electric meter. The jury returned its verdict for Borden. On appeal to the United States Court of Appeals for the Seventh Circuit, Altobello argued the trial judge erred in admitting evidence of his prior conviction.
