Facts
Nathan Altschuller (plaintiff) was attempting to life a heavy boiler when he was suddenly overcome with heartburn. Altschuller later suffered a disability. According to testimony, the disability was a result of the incident that Altschuller had suffered. The trial court admitted Altschuller’s hearsay statement, which he had dictated to Bressler (the employer’s brother) and found that his disability was caused by his work injury. Jacob Bressler (defendant), his employer, appealed, but the appeals court upheld the trial court. Bressler appealed to the New York Court of Appeals, New York’s highest court.
