Amchem Products Inc. v. British Columbia
Canada Supreme Court
[1993] 1 S.C.R. 897
- Written by David Bloom, JD
Facts
Residents of British Columbia (the BC residents) (defendants) sued United States asbestos manufacturers (the US manufacturers) (plaintiffs) in Texas. The Texas court exercised jurisdiction over the case against the US manufacturers. The US manufacturers filed an action in Canada seeking an antisuit injunction barring the BC residents from pursuing the case in Texas. The US manufacturers argued that Canada, not Texas, was the proper forum. The Canadian trial court granted the antisuit injunction against the BC residents. The Texas court responded by issuing an anti-antisuit injunction, permitting the BC residents to litigate the case in Texas. The BC residents appealed the Canadian trial court’s grant of the antisuit injunction.
