Facts
An episode of the television series “The Untouchables” depicted the 1934 transfer of Al Capone from an Atlanta penitentiary to Alcatraz by two armed guards. The episode suggested that one of the two guards accepted a bribe and attempted to help Capone escape. Simpson (plaintiff), one of the two guards from the event on which the episode was based, brought suit against the owner of the network, American Broadcasting-Paramount Theaters, Inc. (ABC) (defendant), and the local affiliate, Crosley Broadcasting Company of Atlanta (Crosley) (defendant). Demurrers from ABC and Crosley were overruled. ABC and Crosley appealed. The Georgia Court of Appeals granted certiorari.
