Facts
American Can Company (plaintiff) alleged that its former employee Ishwar Mansukhani (defendant) stole ink formulas and other confidential documents and used them to sell Mansukhani’s inks to American Can customers. American Can sought an ex parte temporary restraining order enjoining Mansukhani from selling his inks and permitting American Can employees to enter Mansukhani’s offices to seize evidence. The district court granted the order, which was in effect for 10 days. Mansukhani challenged the order.
