Facts
American Simmental Association (American Simmental) petitioned for post-grant review of a patent held by Leachman Cattle of Colorado, LLC (Leachman) relating to genetic quality of livestock as a predictor of the livestock’s market value. The petition was filed pursuant to the Leahy-Smith America Invents Act, under which patents with an effective filing date of March 16, 2013 or later can be challenged within nine months of their issuance. American Simmental asserted that all of the patent’s claims were invalid for lack of patent-eligible subject matter. Leachman moved to amend the patent with the addition of substitute claims. The United States Patent and Trademark Office Patent Trial and Appeal Board issued a decision.
