Facts
Verle Trainer (plaintiff) had two jobs. Trainer worked a few hours per week for American Uniform & Rental Service (American) (defendant) repairing and rebuilding machinery. In addition, Trainer worked full-time for Master Plastics as a night foreman. While working for American, Trainer sustained multiple work-related injuries. Trainer filed a workers’-compensation claim for disability benefits. The Industrial Relations Commission determined that because Trainer’s work for American was dissimilar to his work for Master Plastics, only his American wages could be considered in determining his average weekly wage. The full commission affirmed, and Trainer appealed.
