Facts
Amstar Corporation (plaintiff) held a patent on a process and apparatus designed to separate solids from liquid on an industrial scale in a relatively short time span. Amstar brought an infringement action against Envirotech Corporation (defendant) and Energy Fuels Nuclear, Inc. (EFN) (defendant) in federal district court. The allegedly infringing product and process involved a mechanical mixer that was not present in Amstar’s patent. The court found that this modification supported a finding of noninfringement. Amstar appealed to the United States Court of Appeals for the Federal Circuit.
