Facts
Robin and Sharon Luchini (defendants) sold their house to Raymond Amyot and Shari Luster (plaintiffs). Prior to the sale, the Luchinis volunteered information, both good and bad, about the house’s past and present physical condition. In addition, the Luchinis filled out a statutorily required form disclosing an array of details about the house’s features and characteristics. When Amyot and Luster took possession of the house, they found serious structural defects that the Luchinis had not reported and demanded their money back. The Luchinis refused, and Amyot and Luster sued them to recover the cost of repairs. The trial court entered judgment for the Luchinis. Amyot and Luster appealed to the Alaska Supreme Court.
