Facts
Anaconda Operations Pty Ltd (Anaconda) (plaintiff) contracted Fluor Australia Pty Ltd (Fluor) (defendant) to construct a facility for Anaconda’s nickel and cobalt mine, including an extraction plant, refinery, utility, and associated infrastructure. The contract contained an arbitration clause. A dispute arose regarding the facility’s ability to perform according to the specifications in the contract, and Anaconda sought to recover over $1 billion from Fluor. An arbitration panel was appointed. The issues to be determined by the arbitration panel were complex, and the issues were prone to an extended, drawn-out procedure and hearing.
