Facts
Genoveva Anaya and Alfredo Vides (plaintiffs) were involved in a collision with a Los Angeles garbage truck that had stopped in the road. Anaya and Vides’s 11-year-old daughter, Norma, was injured in the crash and was taken by helicopter to the hospital. On the way to the hospital, the helicopter crashed, and Norma was killed. Anaya and Vides brought a wrongful-death suit against the drivers of the garbage truck, Ralph Diaz and Gabriel Lara (the truck drivers) (defendants), among others. The truck drivers demurred and argued that the crash was a result of the helicopter’s malfunction, for which the helicopter’s manufacturer was responsible. The trial court sustained the truck drivers’ demurrer, finding that Norma’s death was not a foreseeable result of the collision with the garbage truck. Anaya and Vides appealed.
