Facts
Anderson Living Trust (Anderson) (plaintiff) sued WPX Energy Production, LLC (WPX) (defendant) in federal court. WPX possessed 20,000 pages of relevant and discoverable paper documents, which Anderson asked WPX to scan and produce as searchable PDF files. After WPX honored Anderson’s request and produced the PDF files, Anderson successfully petitioned the court to order WPX to organize the files in accordance with Rule 34(b)(2)(E)(i) of the Federal Rules of Civil Procedure. WPX petitioned the court to reconsider its order.
