Facts
Anderson (plaintiff) sued Chicago Brass Co. (defendant). The trial judge instructed the jury on the Anderson’s burden of proof by stating that Anderson must establish the allegations “by a fair preponderance of the credible evidence, facts and circumstances” and must produce evidence that had greater convincing power than the evidence produced by Chicago Brass. The jury returned a verdict in favor of Chicago Brass. Anderson appealed, arguing that the jury instruction was improper.
