Facts
Edward Winter (plaintiff) was admitted into St. Francis-St. George Hospital (defendant) in 1988 due to chest pains and fainting. Winter told his personal physician that he did not want to be resuscitated, because his wife seriously deteriorated after an emergency resuscitation. The physician made the appropriate notations in his chart. However, a nurse later resuscitated Winter by defibrillation, and Winter expressed his gratitude. A few days later, Winter suffered a stroke that paralyzed Winter’s right side. Winter sued the hospital, seeking damages based on the hospital’s failure to follow the do-not-resuscitate order.
