Facts
Andre Anderson (defendant) was charged with second-degree murder based on the shooting death of Richard Holloway. At Anderson’s trial, the prosecutor asked Latarsha Smith, Carlos Stewart, and Alice Stewart whether Anderson told them why he killed Holloway. The witnesses testified that Anderson sold crack cocaine and that Anderson said that he killed Holloway because Holloway stole crack from Anderson. The jury convicted Anderson of Holloway’s murder. Anderson’s conviction was affirmed on direct appeal, and the state courts denied Anderson’s petition for postconviction relief. Anderson then filed a federal habeas corpus petition in the United States District Court for the Western District of Louisiana. One of Anderson’s alleged grounds for relief was that the trial court improperly allowed the prosecution to present other-crimes evidence of Anderson’s drug dealing even though the prosecution had not given proper pretrial notice of the intent to use the evidence.
