Facts
In 1983, the Fisheries Service first adopted a fishery management plan covering commercially fished mackerel, squid, and butterfish. The management plan acknowledged that prey species, such as river herring and shad, were inadvertently caught along with the covered fish species. Anglers Conservation Network (plaintiff) encouraged the Mid-Atlantic Fishery Management Council (council) to propose amendments to the plan to add prey species. The council developed an amendment, but then decided to create a working group and revisit the matter in three years. Anglers sued, arguing that the council was required to pass the amendment adding prey fish to the plan. The government argued that there was no basis for judicial review of the council’s decision. The district court granted the government summary judgment. Anglers appealed.
