Facts
The Animal Protection Institute (institute) (plaintiff) sued Gene Merriam (defendant), in his capacity as commissioner of the Minnesota Department of Natural Resources (DNR). The institute alleged that DNR was improperly granting trapping and snaring permits, resulting in the illegal taking of several endangered species. The institute requested that the court prohibit trapping or change the trapping regulations to ensure protection of the endangered species. The Trappers Association (association), an organization representing commercial and recreational trappers, moved to intervene under Federal Rule of Procedure (FRCP) 24, and the institute opposed the motion.
