Facts
Neumann (plaintiff) sued Antonelli (defendant) after Antonelli stopped making required payments on a loan. Antonelli defended himself by claiming that the two parties had entered into an unlawful usurious transaction so he was relieved of payment. Specifically, two notes on the loan were executed at the statutory legal interest limit amount of 18 percent. At the same time, Antonelli executed an agreement to pay an extra 2 percent interest as a landscape consulting fee to Neumann. The court ruled in Neumann’s favor, finding insufficient evidence. Antonelli appealed.
