Facts
Apex Hosiery Co. (Apex) (defendant) was sued for treble damages under the Sherman Antitrust Act. Citing Fed Rule of Civil Procedure 34, Leader (plaintiff) requested an order for the discovery and production of certain documents for inspection, copying, and photographing to make its case at trial. The court granted the order, and Apex appealed.
