Facts
New Hampshire Revised Statute Annotated § 273 (the RSA) explicitly prohibited supervisory employees from being included in the same bargaining unit as the employees they supervised. The New Hampshire Public Employee Labor Relations Board (PELRB) certified representation of a group of school principals by the Manchester Education Association (the union) (plaintiff), even though it was already representing teachers. The Manchester Board of School Committee (the committee) (defendant) appealed PELRB’s certification decision, contending that, as a matter of law, it would be erroneous for one union to represent both teachers and principals, given the conflict of interest that would arise.
