Application of Moore
United States Court of Customs and Patent Appeals
439 F.2d 1232, 169 U.S.P.Q. 236 (1971)
- Written by Eric Miller, JD
Facts
Robert Moore applied for a patent on mixtures that result from certain hydrocarbon compounds when subject to a high degree of fluorination. The United States Patent and Trademark Office (PTO) board of appeals rejected the first seven claims on the application, which were deemed overly indefinite and imprecise. More specifically, the application apparently failed to disclose the type of fluorination required. Moore appealed to the United States Court of Customs and Patent Appeals.
