Facts
Arab African Energy Corp. (AAEC) (plaintiff) and Olieprodkten Nederland B.V. (ONBV) (defendant) formed a contract through two telex messages. The messages stated, “English law—arbitration, if any, London according to ICC [International Chamber of Commerce] Rules.” An award was issued in favor of AAEC, and ONBV appealed to the England and Wales High Court of Justice. AAEC argued that ONBV did not have the right to appeal the award, because the parties had incorporated the rules of the International Chamber of Commerce (ICC) into the contract, Article 24 of which operated to exclude the right to appeal an arbitration award.
