Facts
In a dispute between Arabian American Oil Co. (plaintiff) and Lee Letterio Scarfone and Lee Scarfone Associates (defendants) that was slated for trial, the court ordered the parties to first participate in a summary jury trial. Robert Work and Jerry Konidaris (defendants) filed motions to excuse their participation in the summary trial. Work contended that settlement was not possible, and Konidaris argued that because he lived and worked in Greece, attendance at summary-trial proceedings by him or his attorney would be financially prohibitive.
