Facts

The Hotel, Motel, and Restaurant Employees International Union (the union) organized the employees of Aramark Corporation (Aramark) (plaintiff) working at the Superdome and New Orleans Convention Center. The National Labor Relations Board (NLRB) (defendant) alleged Aramark had committed unfair labor practices by telling employees that Aramark would increase employee benefits if they did not support the union and threatening to fire employees who supported the union. At the hearing, the NLRB subpoenaed Aramark. Aramark refused to comply with the subpoenas. Aramark’s counsel called the decision not to comply with the subpoena a business decision. Aramark’s counsel also walked out of the hearing at one point, which forced several witnesses to return to the hearing the next day despite initially only being scheduled to appear for one day.
