Facts
Melisa Arbino (plaintiff) sued Johnson & Johnson (defendant) in federal court, alleging that she sustained injuries caused by the Ortho Evra Birth Control Patch. The trial court certified questions to the Ohio Supreme Court regarding the constitutionality under the Ohio Constitution of Ohio Rev. Code Ann. § 2315.18, which sets damage caps for noneconomic damages.
