Facts
Evening Call Publishing Co. (defendant) published a newspaper. An article was published in the newspaper that closed with the question, “Is it true that a Bellingham cop locked himself and a female companion in the back of a cruiser in a town sandpit and had to radio for help?” Lionel Arcand (plaintiff) along with the other 20 members of the Bellingham police department sued Evening Call Publishing for libel. Evening Call Publishing filed a motion to dismiss on the grounds that the statement did not sufficiently identify any individual person, and the trial court granted the motion. The members of the police department appealed.
