Facts
The cities of Phoenix and Tolleson, Arizona (the Cities) (plaintiffs) discharged treated sewage effluent into the Salt River. The Cities entered contracts agreeing to provide sewage effluent each year to several utility companies. Those utility companies planned to use the water to cool a large nuclear power station. Two downstream appropriators (A Tumbling T parties) (defendants) objected. The trial court ruled in favor of the Cities, finding that the contract was not void.
