Facts
The Armstrongs (defendants) persuaded Maggie McDonald’s minor son to go to Maryland and work as a migrant farm worker. While there, Maggie’s son drowned while swimming. Maggie sued for the deprivation of her son’s services and society, as well as for the cost of transporting his body and funeral costs. The jury awarded Maggie only damages for funeral costs and returning the body. The Armstrongs appealed on the grounds that Maggie had neither alleged nor proved negligence by the Armstrongs.
