Facts
Frederick Ashmore, David Boya, William Simone, and Richard Simeone (the employees) (plaintiffs) all worked for Northeast Petroleum Division of Cargill, Inc. (Cargill) (defendant). Cargill asked the employees to implement discriminatory pricing policies toward Cargill’s customers. This scheme involved Cargill giving lower prices to its more loyal customers. There was no dispute that these policies violated antitrust law. The employees all refused to implement the policies and were fired. As a result, the employees brought suit against Cargill under § 4 of the Clayton Act, seeking the recovery of lost wages and benefits. Cargill moved to dismiss the case on the grounds that the employees lacked standing and that they could not demonstrate any antitrust injury under the Clayton Act.
