Facts
Montana Commissioner of Higher Education Richard Crofts (defendant) held several meetings with groups of multiple presidents and chancellors within Montana’s University System. One group referred to itself as the Policy Committee, whereas another group referred to itself as the Senior Management Group. Crofts refused to allow a reporter from the Associated Press (AP) (plaintiff) to attend the meetings. The AP filed a lawsuit, arguing that the meetings should be open to the public.
