Facts

A.B Parker (plaintiff) bought a Ford truck from Bell Ford, Inc. (Bell) (defendant) in August 1979. Parker complained to Bell soon after the purchase about excessive tire wear. Bell procured a repair for Parker’s tire problem with an alignment shop, but the problem continued after the attempted repair. Despite the failure of repair, Parker did not complain of it again to Bell, nor did he register a complaint with the truck manufacturer, Ford Motor Company, Inc. (defendant). In July 1980, Parker sued Bell and Ford Motor Co. After suit was filed, it came out that the excessive wear of the truck’s tires was caused by defective wheel housing. At the close of trial, the court granted the defendants’ motion for a directed verdict in their favor. Parker appealed.
