Facts
The Association of Relatives and Friends of AIDS Patients (A.F.A.P.S.) (plaintiff) sought to operate an AIDS hospice in a residential neighborhood. Nearby residents expressed significant opposition to the establishment of the hospice. The Administracion de Reglamentos y Permisos (A.R.P.E.) (defendant) refused to grant A.F.A.P.S. a permit to operate the hospice, claiming that a zoning regulation limited the area to agricultural use. A.F.A.P.S. brought suit claiming a violation of the Fair Housing Act for discrimination on the basis of handicap.
